Terms of Service

Batiscan is a digital platform operating in Spain that provides:

1. 3D Scanning Services — Professional property digitization delivered by our team, resulting in virtual tours, point clouds, BIM models, and 2D floor plans.

2. Property Marketplace — A listing platform where property owners, agents, and developers can publish real estate for sale or rental, and where buyers and tenants can browse and submit devis requests.

3. Wallet Authentication — Optional login via a Solana-compatible cryptocurrency wallet. This is an authentication mechanism only. No blockchain transactions, token purchases, or on-chain operations are conducted through Batiscan at this time.

You must be at least 18 years old to create an account. By registering, you represent and warrant that:

• You are at least 18 years of age
• You are legally capable of entering into binding contracts under Spanish law
• The information you provide during registration is accurate and current
• You are not barred from using the services under applicable law

3.1 You may register using an email address and password, or by connecting a Solana-compatible wallet. Both methods create the same account type with identical access.

3.2 You are responsible for maintaining the confidentiality of your credentials. You must notify us immediately at support@batiscan.com if you suspect unauthorized access to your account.

3.3 You are responsible for all activity that occurs under your account. Batiscan is not liable for losses resulting from unauthorized use of your account where you failed to take reasonable security precautions.

3.4 One person may not maintain more than one active account. Accounts created to circumvent a previous suspension are prohibited.

Booking and access

When you request a 3D scan, you agree to:

• Provide accurate address and access information
• Ensure the property is accessible at the agreed time
• Obtain any necessary permissions from third parties (co-owners, tenants, landlords) before the scan takes place
• Ensure the space is in a condition suitable for scanning (cleared of personal items where requested)

Deliverables

Upon completion of a scan, we will deliver the agreed outputs (virtual tour, point cloud, BIM file, 2D floor plans) within the timeframe specified at booking. Deliverables are made available through your Batiscan account.

Intellectual property of scan outputs

The 3D scan data, models, and derivative files we produce for your property are licensed to you for use in connection with that property. You may use them for listing, marketing, architectural, or construction purposes. You may not resell or sublicense the raw scan data to third parties without our written consent.

Cancellations

You may cancel or reschedule a scan request up to 24 hours before the scheduled appointment without charge. Cancellations within 24 hours may be subject to a rescheduling fee.

Listing requirements

To list a property, you must:

• Be the owner of the property, or hold written authority from the owner to list it
• Provide accurate information about the property (location, size, type, condition)
• Not include false, misleading, or fraudulent information
• Hold all necessary rights to any photos, documents, or other materials you upload

Devis requests

5.2 A "devis" on Batiscan is a formal expression of interest submitted by a prospective buyer or tenant to a property owner or listing agent. It is not a legally binding offer, a contract, or a payment. No financial transaction of any kind is processed through Batiscan when a devis is submitted or accepted.

Any subsequent agreement, negotiation, contract, or financial transaction between the parties takes place entirely outside of Batiscan and is governed by the applicable laws of Spain. Batiscan is not a party to any such agreement and bears no liability for its outcome.

Prohibited listings

You may not list:

• Properties you do not own or have no authority to list
• Properties subject to ongoing legal disputes that would prevent a transaction
• Properties described with materially false or misleading information
• Content that violates any applicable law

Listing removal

Batiscan reserves the right to remove any listing that violates these Terms, without notice and without liability.

Scope

6.1 Batiscan supports authentication via Solana-compatible wallets (e.g., Phantom, Solflare). This feature allows you to log in using your wallet's cryptographic signature in lieu of an email/password combination.

No financial transactions

6.2 Batiscan does not process, initiate, or facilitate any cryptocurrency transactions, token transfers, NFT minting, or smart contract interactions at this time. Connecting your wallet to Batiscan does not authorize us to access, move, or interact with any funds or assets in your wallet.

Your wallet, your responsibility

6.3 You are solely responsible for the security of your wallet, private keys, and seed phrase. Batiscan has no ability to recover a lost wallet or reverse any on-chain transaction. If you lose access to your wallet, you may recover your Batiscan account through email verification if you have an email address on file.

Future features

6.4 Batiscan may introduce blockchain-related features in the future (including but not limited to on-chain transaction recording or tokenized assets). Any such features will be governed by updated Terms and will require explicit user consent before activation.

7.1 When you upload content to Batiscan (property photos, documents, descriptions, messages), you grant Batiscan a non-exclusive, royalty-free, worldwide license to store, display, and process that content solely for the purpose of operating the platform and delivering the services you have requested.

7.2 You represent and warrant that you own or have the necessary rights to all content you upload, and that it does not infringe any third-party intellectual property rights.

7.3 You may not upload content that is:

• Fraudulent, false, or misleading
• Defamatory, abusive, or harassing
• In violation of any law or regulation
• Malware, viruses, or any harmful code

You agree not to:

• Use the platform for any unlawful purpose
• Impersonate any person or entity
• Scrape, crawl, or harvest data from the platform without written permission
• Attempt to gain unauthorized access to any part of the platform
• Interfere with the platform's operation or infrastructure
• Create accounts to circumvent suspensions or restrictions
• Use the platform to facilitate money laundering, fraud, or other financial crime

9.1 Batiscan is a technology platform that connects property owners, buyers, tenants, and professionals. We are not a real estate agent, broker, financial advisor, or legal advisor.

9.2 We do not verify the legal status, ownership, or freedom from encumbrance of any listed property. You are solely responsible for conducting your own due diligence before engaging in any property transaction.

9.3 To the fullest extent permitted by applicable law, Batiscan's liability to you for any claim arising from these Terms or your use of the platform shall not exceed the total amount you have paid to Batiscan in the 12 months preceding the claim.

9.4 We are not liable for: loss of profits, loss of data, indirect or consequential damages, or any damages arising from transactions concluded between users outside of the platform.

You agree to indemnify and hold harmless Batiscan, its directors, employees, and partners from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

11.1 You may close your account at any time by contacting support@batiscan.com or through the account settings. Upon closure, your listings will be removed and your personal data processed in accordance with our Privacy Policy.

11.2 Batiscan may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law.

These Terms are governed by and construed in accordance with the laws of Spain. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of [City of registration], Spain, without prejudice to your rights as a consumer under applicable EU consumer protection law.

We may update these Terms periodically. We will notify registered users by email at least 15 days before material changes take effect. Continued use of the platform after changes take effect constitutes acceptance.
